Terms of Service
The rules for using Errandss as a customer or service provider.
1. Introduction
Welcome to Errands App (“the App”), a digital marketplace platform connecting independent service providers with customers seeking services such as hairdressing, mechanical work, cleaning, and other errands. By downloading, accessing, or using the App, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the App.
2. Definitions
In these Terms:
- “Platform” means the Errands App and associated services.
- “User” means any person accessing the App.
- “Customer” means a User requesting services via the App.
- “Service Provider” means a User offering services via the App.
- “Services” means offline, real-world services arranged through the App.
3. Nature of the Platform
Errands App is a technology intermediary and does not provide services itself. Service Providers are independent contractors, not employees, agents, or partners of Errands App. The App facilitates connections only; all service agreements are concluded directly between Users.
4. Eligibility
Users must be at least 18 years old or have legal capacity. Service Providers warrant that they are legally permitted to offer their services and hold all necessary licenses, permits, or qualifications.
5. Account registration
Users must provide accurate and complete information and are responsible for maintaining the confidentiality of their account. The App reserves the right to suspend or terminate accounts for fraud, misrepresentation, or breach of these Terms.
6. Service bookings and agreements
Customers may request services through the App, and Service Providers may accept or decline requests. Once accepted, a binding agreement is formed between the Customer and the Service Provider. Errands App is not responsible for the quality or completion of services, or for any disputes between Users. Users agree that pricing is set by Service Providers and that the Platform may display estimated pricing only.
7. Payments, billing and financial terms
7.1 Payment methods
The App may provide Users with the option to make payments for services directly to Service Providers (offline or external methods), or through integrated in-app payment processing systems (“In-App Payments”). In-App Payments are facilitated via third-party payment service providers (“Payment Processors”). Errands App does not itself process or store full payment card details. By using In-App Payments, Users agree to comply with the terms and conditions of the relevant Payment Processor.
7.2 Nature of payments
Payments facilitated through the App relate to real-world, offline services. Accordingly, such payments are not classified as digital goods or content, and the App is not required to exclusively use Apple or Google in-app purchase systems for such transactions. Where any digital features are introduced in future, the App reserves the right to implement platform-mandated billing systems.
7.3 Payment flow and authorisation
When a Customer elects to pay via the App, the Customer authorises the Payment Processor to charge the selected payment method. Payment may be authorised immediately but captured only upon service confirmation, depending on system design. The App may implement pre-authorisations, escrow or holding mechanisms, and delayed settlement to Service Providers. The Customer agrees that once a payment is authorised, it may not be reversed except in accordance with the Refund Policy or applicable law.
7.4 Fees and commissions
Errands App may charge service fees to Customers and commission fees to Service Providers. All applicable fees will be disclosed prior to payment confirmation. The Platform reserves the right to amend its fee structure with reasonable notice.
7.5 Payouts to Service Providers
Payments made via the App may be held temporarily and released to the Service Provider after confirmation of service completion. Service Providers agree that payouts may be subject to verification checks, fraud prevention measures, and Payment Processor timelines. Errands App is not responsible for delays caused by Payment Processors or banking institutions.
7.6 Payment data and security
Errands App does not store full card details. Payment information is processed securely by certified Payment Processors in compliance with industry standards. The App may store limited payment-related data, including transaction history, payment status, and partial identifiers (for example, the last four digits of a card). All personal and payment-related data is handled in accordance with the Privacy Policy and applicable data protection laws.
7.7 User responsibilities
Customers agree to provide accurate payment information, ensure sufficient funds are available, and not initiate fraudulent chargebacks. Service Providers agree to honour confirmed bookings, not request off-platform payments to avoid fees, and comply with all applicable tax and financial regulations.
7.8 Failed or disputed payments
If a payment fails, the service request may be cancelled and access to the App may be restricted. In the event of a dispute, Users must first attempt resolution directly; the App may assist but is not obligated to adjudicate. Chargebacks or reversed payments may result in immediate suspension of the User account and recovery actions for amounts owed.
7.9 Fraud and risk management
Errands App reserves the right to conduct verification checks, delay or block transactions, and suspend accounts suspected of fraud. Users consent to reasonable monitoring of transactions for security purposes.
7.10 Taxes
Service Providers are solely responsible for declaring and paying all applicable taxes and for compliance with local tax laws. The Platform may provide transaction summaries but does not act as a tax advisor.
7.11 Refunds and reversals
Refunds are governed by the Refund & Cancellation Policy. Where payments are processed via Payment Processors, refunds may be subject to their processing rules and timelines.
7.12 Limitation of liability (payments)
To the maximum extent permitted by law, Errands App shall not be liable for payment failures, banking errors, processor outages, or unauthorised transactions not caused by the App’s negligence.
7.13 Indemnity (payments)
Users indemnify Errands App against any claims arising from unauthorised use of payment methods, fraudulent transactions, or breach of payment-related obligations.
7.14 Suspension of payment features
Errands App reserves the right to disable payment functionality or restrict access to financial features where required for legal compliance, risk management, or platform integrity.
8. User conduct
Users agree not to:
- Engage in fraud, theft, or illegal conduct.
- Misrepresent services or qualifications.
- Circumvent the Platform to avoid fees.
- Upload harmful, offensive, or unlawful content.
9. Data privacy and protection
The App collects and processes personal data in accordance with its Privacy Policy. In compliance with global standards (including GDPR principles reflected in app store rules), data collection is limited to what is necessary, user consent is obtained where required, and Users may request deletion of their data. The App will not sell personal data without consent.
10. Safety and liability disclaimer
Errands App does not guarantee the identity verification of Users or the quality or safety of services. Users engage at their own risk. To the maximum extent permitted by law, Errands App shall not be liable for injury, loss, or damage arising from services, or for the misconduct of Users.
11. Ratings and reviews
Users may leave reviews. Reviews must be honest, non-defamatory, and not abusive. The App reserves the right to remove inappropriate content.
12. Intellectual property
All rights in the App belong to Errands App. Users may not copy, distribute, or reverse engineer the App.
13. Termination
The App may suspend or terminate access if these Terms are breached, if required by law, or if necessary for safety or integrity.
14. Confidentiality
Users agree not to disclose confidential information obtained through the App, including business practices, customer details, and Service Provider information.
15. Dispute resolution
Users must attempt to resolve disputes directly. The Platform may assist but is not obligated to intervene. Legal disputes shall be governed by the laws of South Africa.
16. Compliance with app store requirements
The App complies with safety, privacy, and transparency requirements, and with accurate disclosure and functionality requirements. Users acknowledge that the App may be removed or restricted if required by platform operators, and that certain features may be modified to comply with store policies.
17. Amendments
These Terms may be updated at any time. Continued use of the App constitutes acceptance of the updated Terms.
